Title vs. Deed: Understanding the Difference



When it comes to real estate transactions, there are several legal terms that can be confusing, including "title" and "deed." While these terms are often used interchangeably, they actually have distinct meanings and roles in the realm of property ownership. Understanding the difference between title and deed is crucial, whether you're buying or selling a property. What is a Title?

Once the deed is recorded, it becomes a public record, serving as proof of the transfer of ownership.


Types of Deeds

  3. Quitclaim Deed: A quitclaim deed is often used in situations where there is no monetary consideration involved or when transferring property between family members or within a divorce settlement. It transfers whatever interest the grantor has in the property, without making any warranties.


Understanding the Distinction
